First Choice Dental has agreed to a $1.225 million class action settlement to resolve allegations that it failed to protect consumer data during a 2023 data breach.
The settlement benefits individuals in the United States whose private information was exposed in the October 2023 data breach discovered by First Choice Dental, a dental practice with multiple locations in Wisconsin.
While the company denies any wrongdoing, it agreed to the settlement to resolve the claims without further litigation.
What Happened in the Data Breach
According to the lawsuit, the First Choice Dental data breach allegedly compromised highly sensitive personal information, including:
- Names
- Dates of birth
- Social Security numbers
- Driver’s license numbers
- Financial account details
- Health information
Plaintiffs claim the company failed to properly safeguard this data, leading to an increased risk of fraud and identity theft for affected individuals.
Settlement Benefits and Payments
Under the terms of the agreement, class members may receive the following benefits:
- Up to $6,000 for documented economic losses related to the data breach. Eligible expenses include:
- Fraud or identity theft losses
- Professional or legal fees
- Credit monitoring or repair costs
- Other verifiable financial losses
- $50 cash payment for class members who did not experience measurable economic losses.
Additionally, all class members will receive three years of free credit monitoring and $1 million in identity theft protection insurance at no cost.

The settlement applies to any U.S. resident whose private information was compromised in the First Choice Dental data breach discovered in October 2023.

Those claiming economic losses must provide proof of damages, which may include:

- Bank or account statements
- Invoices
- Bills
- Other supporting documentation

- Exclusion or Objection Deadline: December 29, 2025
